SPEAKER MIKE HUBBARD SEEKING TO THROW OUT ETHICS CHARGES

OPELIKA, Ala. (AP) – A judge is leaving open the possibility that indicted House Speaker Mike Hubbard can take additional testimony from Attorney General Luther Strange and his employees as he tries to get ethics charges thrown out.

Lee County Circuit Judge Jacob Walker Tuesday laid groundwork Tuesday for a key hearing next week.

Walker didn’t rule on a state motion to dismiss defense subpoenas for Strange and some workers. Instead, Walker says he will decide later.

Walker did indicate that any testimony from Strange and his employees would be taken outside court.

Hubbard is scheduled to go to trial next year on state ethics charges. He is trying to get the case dismissed by arguing selective prosecution and prosecutorial misconduct.

Hubbard also says the state ethics law which he supported is unconstitutionally vague.
