TUSCALOOSA– Four men, 3 of them University of Alabama students, are facing rape charges after police said they sexually assaulted of a 22-year-old woman at a party.

Eddie Harris Jr., 19; Fredrick Shaw, 18; DeAndre Dussett, 25; and Donald King, 20, are charged with first-degree rape after admitting to having sex with a 22-year-old black woman while she was unconscious.

The incident occurred the night of Oct. 5 and into the next day on the 5500 block of old Montgomery Highway.

Witnesses said they found the victim unresponsive inside Boardwalk apartments. She was later transported to DCH Regional Medical Center.

Witnesses said the victim had been purposefully consuming an alcoholic beverage with Xanax in it.

Capt. Gary Hood of the Tuscaloosa County Metro Homicide Unit said the victim was not the only woman at the party and that the drink was passed around to multiple people at the party.

Authorities said witnesses claimed the victim passed out in King’s bedroom and that at least three of the suspects were inside the bedroom with the victim at the same time.

Her condition is believed to be non-life threatening.

Hood said he does not believe the rapes were preconceived.

“That was not the intent of passing the drink around to intentionally knock her out to have sex with her, but that was the ultimate thing that happened,” Hood said. “That was not the goal as far as I know at this time.”

Hood said investigators are still working on the details and a timeline for the incident. He said the incident is not legally considered gang rape.

“Overindulgence of alcohol is our main concern and we see that on a weekly basis which leads to these sexual assault and rape reports,” Hood said. “The primary reason behind these reports is underage drinking and, I would say, binge drinking.”
